छात्र प्रदर्शन पर पुलिस कार्रवाई की होगी निष्पक्ष जांच, राष्ट्रीय प्रोटोकॉल बनाने के संकेत: सुप्रीम कोर्ट

परीक्षा अनियमितताओं और नीट पेपर लीक को लेकर देशभर में हुए छात्र प्रदर्शनों के दौरान पुलिस की कथित ज्यादती के आरोपों पर सुप्रीम कोर्ट ने मंगलवार को गंभीर चिंता जताई। मुख्य न्यायाधीश Surya Kant की अध्यक्षता वाली पीठ ने कहा कि पुलिस कार्रवाई से जुड़े आरोपों की निष्पक्ष, पारदर्शी और स्वतंत्र जांच आवश्यक है, ताकि सच्चाई सामने आ सके और जवाबदेही तय हो सके। सुनवाई के दौरान अदालत के समक्ष प्रदर्शनकारियों पर पेलेट गन, आंसू गैस, लाठीचार्ज, इलेक्ट्रिक शॉक हथियारों के इस्तेमाल और सुरक्षा बलों द्वारा मारपीट किए जाने के आरोप रखे गए। सुप्रीम कोर्ट ने स्पष्ट किया कि उसने अभी तक यह निष्कर्ष नहीं निकाला है कि पेलेट गन का वास्तव में इस्तेमाल हुआ था या नहीं। हालांकि, अदालत ने कहा कि लगाए गए आरोप प्रथम दृष्टया स्वतंत्र जांच की मांग करते हैं और इसके लिए विशेष जांच दल (SIT) या उच्चस्तरीय समिति गठित करने पर विचार किया जा सकता है। सुप्रीम कोर्ट ने यह भी कहा कि जांच का उद्देश्य केवल जिम्मेदारी तय करना नहीं होना चाहिए, बल्कि भविष्य के लिए एक समान राष्ट्रीय प्रोटोकॉल भी तैयार किया जाना चाहिए। अदालत का मानना है कि देशभर में विरोध-प्रदर्शनों और भीड़ नियंत्रण के दौरान पुलिस किस प्रकार कार्रवाई करे, इसके लिए स्पष्ट और एकरूप दिशा-निर्देश होने चाहिए, ताकि कानून-व्यवस्था बनाए रखने के साथ-साथ नागरिकों के शांतिपूर्ण प्रदर्शन के संवैधानिक अधिकारों की भी रक्षा हो सके। यह टिप्पणी 20 जुलाई को दिल्ली के जंतर-मंतर पर हुए "कॉकरोच जनता पार्टी" के प्रदर्शन और उसके बाद देश के विभिन्न हिस्सों में हुए विरोध प्रदर्शनों के संदर्भ में आई है। सुप्रीम कोर्ट की यह पहल पुलिस कार्रवाई में पारदर्शिता, जवाबदेही और संवैधानिक मूल्यों के पालन को सुनिश्चित करने की दिशा में एक महत्वपूर्ण कदम मानी जा रही है।
Supreme Court Signals Need for Impartial Probe into Police Action Against Student Protesters and Formulation of National Protocol

On Tuesday, the Supreme Court expressed serious concern regarding allegations of police excesses during nationwide student protests over examination irregularities and the NEET paper leak. A bench led by Justice Surya Kant stated that an impartial, transparent, and independent investigation into the allegations concerning police action is essential to uncover the truth and establish accountability. During the hearing, allegations were presented before the court regarding the use of pellet guns, tear gas, lathi-charges, and electric shock weapons against protesters, as well as instances of physical assault by security forces. The Supreme Court clarified that it had not yet reached a conclusion on whether pellet guns were actually used. However, the court observed that the allegations *prima facie* warrant an independent inquiry, and the formation of a Special Investigation Team (SIT) or a high-level committee could be considered for this purpose. The Supreme Court further stated that the objective of the investigation should not merely be to fix responsibility but also to formulate a uniform national protocol for the future. The court holds the view that there should be clear and consistent guidelines governing police conduct during protests and crowd control across the country, ensuring that the constitutional right of citizens to peaceful protest is protected alongside the maintenance of law and order. These observations were made in the context of the "Cockroach Janata Party" protest at Delhi's Jantar Mantar on July 20 and subsequent protests held in various parts of the country. This initiative by the Supreme Court is being viewed as a significant step towards ensuring transparency, accountability, and adherence to constitutional values in police actions.
