हिमाचल प्रदेश के शिक्षकों और कर्मचारियों के लिए सुप्रीम कोर्ट से बड़ी राहत भरी खबर आई है। सर्वोच्च न्यायालय ने भर्ती एवं सेवा शर्त अधिनियम-2024 को लेकर हिमाचल हाईकोर्ट के फैसले को बरकरार रखते हुए राज्य सरकार की अपील खारिज कर दी है। इसके साथ ही अनुबंध अवधि से जुड़े वित्तीय लाभ, वरिष्ठता और अन्य सेवा संबंधी लाभ बहाल होने का रास्ता साफ हो गया है। हिमाचल प्रदेश महाविद्यालय शैक्षिक संघ (एचपीएमसीटीए) के प्रदेश अध्यक्ष देवेंद्र एटलस ने फैसले का स्वागत करते हुए कहा कि दिसंबर 2024 में लागू किए गए इस अधिनियम को शिक्षकों और कर्मचारियों ने हाईकोर्ट में चुनौती दी थी। हाईकोर्ट ने कानून को निरस्त करते हुए अनुबंध अवधि के सभी वित्तीय और सेवा लाभ बहाल करने का आदेश दिया था। राज्य सरकार ने इस फैसले के खिलाफ सुप्रीम कोर्ट में अपील की, लेकिन वहां भी हाईकोर्ट के निर्णय को सही ठहराया गया। देवेंद्र एटलस ने कहा कि इस फैसले से लंबित विभागीय पदोन्नति समितियों (डीपीसी) का रास्ता साफ होगा और शिक्षकों व कर्मचारियों को वरिष्ठता सहित सभी वैधानिक लाभ मिल सकेंगे। उन्होंने कहा कि इसका लाभ केवल कॉलेज कैडर तक सीमित नहीं रहेगा, बल्कि अन्य विभागों के पात्र कर्मचारियों को भी मिलेगा। उन्होंने राज्य सरकार से सुप्रीम कोर्ट के आदेशों को चार महीने के भीतर पूरी तरह लागू करने की मांग की। एटलस ने कहा कि सरकार ने स्वयं फैसले को लागू करने के लिए चार महीने का समय मांगा है, इसलिए तय समयसीमा में सभी लाभ बहाल किए जाने चाहिए। उन्होंने उम्मीद जताई कि सरकार न्यायालय के आदेशों का सम्मान करते हुए बिना किसी अनावश्यक देरी के निर्णय को लागू करेगी, जिससे हजारों कर्मचारियों को राहत मिलेगी।

Teachers and employees in Himachal Pradesh have received welcome news from the Supreme Court. The apex court has dismissed the state government's appeal, thereby upholding the Himachal High Court's verdict regarding the Recruitment and Service Conditions Act-2024. This decision paves the way for the restoration of financial benefits, seniority, and other service-related perks linked to the contract period. Welcoming the verdict, Devendra Atlas, State President of the Himachal Pradesh Government College Teachers' Association (HPMGCTA), noted that teachers and employees had challenged the Act—implemented in December 2024—in the High Court. The High Court had struck down the law and ordered the restoration of all financial and service benefits associated with the contract period. Although the state government appealed against this ruling in the Supreme Court, the High Court's decision was upheld there as well. Atlas stated that this verdict clears the path for pending Departmental Promotion Committee (DPC) proceedings and ensures that teachers and employees receive all statutory benefits, including seniority. He added that the benefits would not be limited to the college cadre alone but would also extend to eligible employees in other departments. He urged the state government to fully implement the Supreme Court's orders within four months. Atlas pointed out that the government itself had sought a four-month timeframe to implement the verdict; therefore, all benefits should be restored within this stipulated period. He expressed hope that the government would respect the court's orders and implement the decision without unnecessary delay, thereby bringing relief to thousands of employees.
