निजी व्हाट्सऐप बातचीत पर HRTC कंडक्टर की नौकरी बहाल

हिमाचल प्रदेश हाईकोर्ट ने एचआरटीसी के अनुबंधित परिचालक सुनील कुमार की बर्खास्तगी का आदेश रद्द करते हुए उनकी नौकरी बहाल करने के निर्देश दिए हैं। अदालत ने कहा कि निजी व्हाट्सऐप ग्रुप में कर्मचारियों के बीच हुई बातचीत को सार्वजनिक आलोचना नहीं माना जा सकता। कर्मचारियों को अपनी शिकायतें और नाराजगी व्यक्त करने का अधिकार है। मामला सितंबर 2023 में बनाए गए ‘हिमाचल परिचालक एकता’ नामक व्हाट्सऐप ग्रुप में भेजे गए संदेशों से जुड़ा था। सुनील कुमार ने निगम के नए नियमों और कर्मचारियों पर उनके संभावित प्रभावों को लेकर चर्चा की थी। एचआरटीसी ने इसे सोशल मीडिया दिशानिर्देशों और अनुबंध की शर्तों का उल्लंघन मानते हुए 10 अक्टूबर 2023 को उनकी सेवाएं समाप्त कर दी थीं। हाईकोर्ट ने इस आदेश को रद्द कर दिया

The Himachal Pradesh High Court has set aside the dismissal order of HRTC contractual conductor Sunil Kumar and directed his reinstatement. The Court observed that conversations held among employees in a private WhatsApp group cannot be construed as public criticism; employees have the right to express their grievances and dissatisfaction. The matter stemmed from messages sent in a WhatsApp group named 'Himachal Parichalak Ekta' (Himachal Conductors' Unity), created in September 2023. Sunil Kumar had discussed the corporation's new rules and their potential impact on employees. HRTC had terminated his services on October 10, 2023, deeming the messages a violation of social media guidelines and the terms of his employment contract. The High Court has quashed this order.
